Amazon refunded FBA order nearly after 2 years of a sale

Hi All,

Amazon just refunded an FBA sale from Aug 2021, I mean sold more then 1 and a half years ago. I have contacted Amazon support, they have told me they we view each case individually and told me it is to help with customer satisfaction?

It is an electronic item with 2 years warranty and it is over £300. I mean how is this possible and what should I do?

Hopefully it was the calendar you used to work that out?

If you have no joy with seller support - have they told you the reason for the refund - then escalate to managingdirector@amazon.co.uk - but try and get your dates right!

I don’t understand why people go to Amazon after so long.

when my 18 month old George Foreman grill started playing up I went to George Foreman who kindly sent me out a new one under my 2 year warranty. The thought never crossed my mind to contact the seller on Amazon after such a time.

So in theory I could also go complain to Amazon who will refund me?

Surely there’s a certain point of time (30 days?) when the retailer is no longer responsible and the manufacturer is?

As it’s still in warranty you should have the option to return it to where you got it from too. I would appeal and state that you shouldn’t refund until an item is returned and insist that you need the item back, quote the amazon policy and also trading standards. You can then return it to where you got it from for your own refund.

This is standard for amazon and nothing you can do unless they don’t return it. Amazon will refund literally anything even after 2+ years if the customer complains enough. I once had a tablet returned well over 2 years after the sale date and the reason given was “weak glass” i.e they dropped it, smashed the screen and despite this and it being more than 2 years later - amazon allowed the return and would not reimburse (this was an FBA item).

Manufacturers warranties are always in addition to your statutory rights - not a replacement

Sale of Goods Act places the onus on the retailor and not the manufacturer - and does not specify a time limit - only that goods must last a ‘reasonable’ amount of time. When a retailor sells something it is them the customer has a contract with - not the manufacturer.

So it might be reasonable to expect a £20 kettle to last at least 12 months but for an item costing £300 then it might be reasonable to expect it to last 3 years, etc

If still within a manufacturers warranty then the customer can claim against the manufacturer or retailor or the retailor should help them with such a claim, but ultimately, the claim is still against the retailor.

I have had exactly the same thing happen to me.
It is a problem, with selling FBA.

What should happen, is that the customer can contact you for a repair etc, or if a warranty exists, claim under that.
However, Amazon have a habit of ignoring this and just resolve the problem, by providing a refund to the customer.
They “may” cover it themselves, but it’s unlikely. As such, they simply see it as good customer service and really don’t give a damn, that we have to carry the cost, regardless of the actual law.
This is because they offer something that is over and above the statutory minimums.

Had exactly the same thing happen to me on a Video Game controller … its not like these things don’t wear out! Refunded 20 months after the sale.

Try MD and everything but got no where. Gave up… yet another reason why I try and buy as little as I can from the platform as it leaves such a bitter taste in your mouth as a seller.

Amazon granted a return on a Video Game controller on an order made over 20 months ago

I questioned this fact as I do not think any return should of been granted on a product that is subject to wear and tear unless its within the normal 30 days window

Seller support directed me to this page

In most EU countries, any defect that becomes apparent within 6 months from delivery is presumed to have existed at the time of delivery and therefore you must repair, exchange or reimburse it. After 6 months,in most EU countries (France excluded), you can request that the customer to prove the defect already existed at the time of delivery. You can find more information regarding the Legal Warranty in the following link from the European Commission.

The key line in here is “After 6 months,in most EU countries (France excluded), you can request that the customer to prove the defect already existed at the time of delivery.”

The order was made over 6 months ago therefore I would like the customer to prove the defect already existed at the time of delivery.

I have asked seller support several times did they get the customer to prove the defect? I think no fault existed and they have just broken the video game controller.

Can I be reimburse for the order as I think the return should not have been accepted.

The other really annoying thing is seller support just keep closing the case rather than answering my question! They are useless, not fit for purpose. In my opinion a lesson on how to do support should be taken from eBay who are a pleasure to work with, are very knowledgeable about their platform.

Can I be reimburse for the order as I think the return should not have been accepted.

The other really annoying thing is seller support just keep closing the case rather than answering my question! They are useless, not fit for purpose. In my opinion a lesson on how to do support should be taken from eBay who are a pleasure to work with, are very knowledgeable about their platform.
