I am a brand agent and sole Amazon seller. for this brand of about The manufacturer has trademark in their country. They are working on their Trademark in US.
I cannot seem to get answers or anyone to help. About 2 weeks ago 'just launched' sellers and some with 'bad reviews' have shown up on four of this brand's top listings, selling counterfeit product. Not a new story. They come and go and new ones show up daily. A look-alike (almost identical) product has shown up and some counterfeit sellers have opened their own listings. I have reported the sellers on the product pages a few times because the list of them changes.
1. What can I do as a brand agent also selling on these listings?? Seller Support suggested filing an infringement but as I tried that there is not a trademark in place in US yet., so no go.
2. I'm afraid to file an infringement anyway because of this warning I keep coming across this warning....Is this true? Would this happen? :
"Filing infringement notices as an agent or brand protection agency: Amazon understands that many brands may choose to have brand protection agencies or agents report intellectual property infringement on their behalf and accepts submissions from authorized agents. However, Amazon does not permit individuals with active selling accounts to file infringement notices as an agent of a brand when the filing of those notices could benefit their own selling account (through removing competing listings, for example). Any sellers filing notices as an agent to benefit their own status as a seller may have their selling account terminated." THIS IS SAYING THEY CAN STAY THERE?

On other forums discussions here, I've read multiple times to do this in Account health: "Report Abuse / The product received is different than the product on the detail page (different version, model or product)" I've tried a dozen times and it doesn't do anything. I get no email. Why? What needs to happen to make this work? There are four boxes to choose from and a box to write in....is there some special combination that works? I've placed hundreds of dollars on purchase of these seller's products. I've only received one that was FBA and that one seller disappeared rather quickly. And, I cannot even report it. Should I call Customer Service and report it that way? I much more product arriving soon.
5. Who and how do I engage with Brand Registry or someone in Amazon who cares about this and can do something?

You ask great questions so I'm gonna answer them to the best of ability!
1. Since a trademark is not an option right now, they will need to be treated as listing violations if they are not accurate representations of the product page they're selling on.
2. As I mentioned above, I recommend going down the road of not reporting infringement as there is no IP that can be reported in this country.
3. We remain committed to continued innovation and will not rest until we drive counterfeits to zero.
4. I'm not 100% sure why you are not receiving emails on these but if you're submitting then the team is receiving them! If you are not receiving these products as were promised by the seller, I do recommend going through customer support AND there is an option on the detail page to Report an issue with this product or seller, this is a link under the "About this item" section where you can describe what's happened.
5. Brand Registry will only be available once the brand is enrolled.
